The mobile application ‘Bellboy’ operated by THE COMPANY i.e Urban Lifestyle Private Limited has provided a marketplace platform household and professional service providers which enables the link between a party/individual seeking for service requirements (“Customer”) and/or a party/individual offering such services (“Service Provider”). Customer and Service Provider together are hereinafter referred to as “Users” and individually as “User”. Those certain services requested by the Customer, which are to be completed by the Service Provider, are hereinafter referred to as “Services”.

About Bellboy application

Bellboy is a mobile marketplace for local services. We are the first startup to fill the void and fulfill the market needs for professional services.

Please note that the incoming calls and emails which made after working hours will be responded by our customer care team on the next working day.

Emails sent to info@bellboy.lk during the working hours will be responded within 1 working day.

Bellboy only provides service/s to Colombo 1-15 and suburb areas. The job request made out of the said regions will not be considered and therefore THE COMPANY is not liable to fulfill the job request.

Calm and clear communication is the most effective way to defuse any disagreement that may arise between the customer and service provider. All the customers and service providers are expected to be treated with respect and courtesy by one another.

Service Types

Inspection :

  • The job acceptance and cancellation are subject to get to the service provider’s availability. Customer may cancel the job request within 30 minutes for any reason. Both recognize that THE COMPANY is not liable for any delays, cancellations, failure to cancel the job request and miscommunication between the customer and the service provider, nor for any delay or failure in the delivery of services from the service provider.
  • Once the job is made under Inspection if there are no service providers, Bellboy customer care team will contact the customer and make a sincere attempt to connect to a service provider.
  • If Bellboy support team fails to connect a service provider to the customer, THE COMPANY has full rights to request the customer to cancel the job request. The booking fee will be refunded.

Estimate :

  • In the Bellboy mobile application, once the job request has been made under free estimate, customer will be notified as to how many agents have received the job request. Quotation/s from the service provider/s will be subject to availability. You will notify through the Bellboy mobile application when the service provider/s sent the quotation to the customer.
  • Once you select free estimate and if you not have received any quotation/s from the service provider/s, Bellboy customer care team will contact the customer and make a sincere attempt to connect to a service provider.
  • If Bellboy support team fails to connect a service provider to the customer, THE COMPANY has full rights to request the customer to cancel the job request. The booking fee will be refunded.

Collection of your Personal Information

THE COMPANY has minimum control over the quality, timing or legality of Services delivered by Service Provider.

THE COMPANY makes only a sincere attempt to provide best Service Providers and hence does not take full responsibility for suitability, reliability, timeliness, or accuracy of the Services requested and provided by Users. Although THE COMPANY does perform background checks of Service Provider, THE COMPANY cannot confirm that each User is whom they claim to be. THE COMPANY does not assume any responsibility for the accuracy or reliability of this information or any information on the Service.

NEITHER THE COMPANY NOR ITS DIRECTORS, OFFICERS, AFFILIATES OR LICENSORS IS RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE SERVICE. THE COMPANY AND ITS DIRECTORS, OFFICERS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY CLAIM, INJURY OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF THE SERVICE.

WE COLLECT AND STORE THE FOLLOWING PERSONAL INFORMATION: NAME, EMAIL ADDRESS, PHONE NUMBER, PRECISE LOCATION, USER ID, DEVICE ID AS WELL AS OTHER INFORMATION, INCLUDING USERS’ IP ADDRESSES AND STANDARD WEB LOG INFORMATION.

Use:

A customer’s personal information is utilized to:

  • Solve user issues, collect payments, and troubleshoot payment issues with mobile service providers and financial institutes.
  • Promote safe trading practices and enforce our policies.
  • Create customized user experiences and monitor their interest patterns.
  • Improve our services and inform users about services and updates.
  • Convey marketing and promotional offers to users which correspond with their areas of interest.
  • Assist new program development activities based on user profiles.

Transactions

Customer offer Service Payments for each requested service. Three days after a service is scheduled, if there is no complaint by the Customer, the service will be marked as closed by THE COMPANY, the agreed upon payment will be transferred to the Service Provider. The Service Payment must be paid only through THE Bellboy mobile application. Any Service Payments paid in cash outside of THE COMPANY mobile application are NOT subject to refunds.

  • Customer pays a service fee set by the company for each service request made, the service fee will be charged through a Dialog or Mobitel connection.
  • Upon agreement of both Customer and Service Provider, the payment for such service/s will be charged through the system.(refer payment options)
  • The quotation/s which is sent by the service provider/s is not final, the final price for the job is subject to the service provider/s inspection and final negotiation.
  • Once the service provider completes the job, the final payment should be made through a visa/Master bank card via the Bellboy application.
  • Once the final payment is made via Visa/Master bank card, the customer will be receiving a payment invoice to their registered email.
  • Final payment should settle within maximum of 24 hours from the completion of the job.
  • * Failing to do the transaction within the agreed time period the COMPANY will take necessary actions for payment recovery.

Customer:

  • Each customer will be charged a standard service fee. Booking fee is subject to change without notice.

    *Customer will be charged.

    *Cancellation before the time-out.(some operators may charge Government taxes on the transaction amount subject to refund policy terms and conditions)

    *Refunds are processed when the customer cancels request within 30 minutes or within a more reasonable time based on the verification process.

    Job Type Cancellation criteria
    Free Estimate Once the booking is confirmed by the customer, within 30 minutes the customer can cancel the booking.
    Inspection The Customer can cancel the inspection within 30 minutes.

    Please note, if the customer fails to cancel the booking within 30 minutes, the service fee will be not refundable.

The use of any website controlled, owned or operated by third parties is governed by the terms and conditions of use and privacy policies for those websites, and not by THE COMPANY 's Terms of Use or Privacy Policy.

Your Information :

“Your Information” is defined as any information and materials you provide to THE COMPANY or other Users in connection with your registration for and use of the Service, including without limitation that posted or transmitted for use in Public Areas. You are solely responsible for Your Information, and we act merely as a passive conduit for your online distribution and publication of Your Information. You hereby represent and warrant to THE COMPANY that Your Information (a) will not be false, inaccurate, incomplete or misleading; (b) will not be fraudulent or involve the sale of counterfeit or stolen items; (c) will not infringe any third party's copyright, patent, trademark, trade secret or other proprietary right or rights of publicity or privacy; (d) will not violate any law, statute, ordinance, or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); (e) will not be defamatory, libelous, unlawfully threatening, or unlawfully harassing; (f) will not be obscene or contain child pornography or be harmful to minors; (g) will not contain any viruses, Trojan Horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; and (h) will not create liability for THE COMPANY or cause THE COMPANY to lose (in whole or in part) the services of its ISPs or other partners or suppliers.

Solely to enable THE COMPANY to use Your Information, you hereby grant us a non- exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise all copyright, publicity rights, and any other rights you have in Your Information, in any media now known or not currently known.

Termination and Suspension

Without limitation, THE COMPANY may terminate or suspend your right to use the Service if you breach any term of this Agreement or any policy of THE COMPANY posted on the Service from time to time, or if THE COMPANY otherwise finds that you have engaged in inappropriate and/or offensive behavior.

Intellectual Property Rights

All text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and other content (collectively “Proprietary Material”) that users see or read on the Service is owned by THE COMPANY or are used by permission. Proprietary Material is protected in all forms, media and technologies now known or hereinafter developed. THE COMPANY owns all Proprietary Material as well as the coordination, selection, arrangement, and enhancement of such Proprietary Materials as a Collective Work under the Intellectual Property Rights Act, as amended.

Confidential Information

You acknowledge that Confidential Information (as hereinafter defined) is a valuable, special and unique asset of THE COMPANY and agree that you will not disclose, transfer, use (or seek to induce others to disclose, transfer or use) any Confidential Information for any purpose other than disclosure to your authorized employees and agents who are bound to maintain the confidentiality of Confidential Information.

The term “Confidential Information” shall mean any and all of THE COMPANY’s trade secrets, confidential and proprietary information and all other information and data of THE COMPANY that is not generally known to the public or other third parties who could derive value, economic or otherwise, from its use or disclosure. Confidential Information shall be deemed to include technical data, know-how, research, product plans, products, services, customers, markets, software, developments, inventions, processes, formulas, technology, designs, drawings, engineering, hardware configuration information, marketing, finances or other business information disclosed directly or indirectly in writing, orally or by drawings or observation.

No Liability

UNDER NO CIRCUMSTANCES WILL THE COMPANY,ITS AFFILIATES, ITS LICENSORS, OR ANY OF SUCH PARTIES' AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, CORPORATE PARTNERS, OR PARTICIPANTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF THE SAME.

If any dispute arises with one or more Service Providers, THE COMPANY (including our officers, directors, agents, investors, subsidiaries, and employees) will not be held responsible /liable from any and all claims, demands, or damages (actual or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Indemnification

You hereby agree to indemnify, defend, and hold harmless THE COMPANY , its directors, officers, employees, agents, licensors, attorneys, independent contractors, providers, subsidiaries, and affiliates from and against any and all claim, loss, expense or demand of liability, including attorneys' fees and costs incurred, arising from your use, quality of service or inability to use the Services etc..

Dispute Resolution and Governing Law

In case of any dispute between the Users and THE COMPANY, the parties agree to resolve the matter amicably vide arbitration under the Law of Sri Lanka.

No Agency

No independent contractor, agency, partnership, joint venture, employer-employee or franchiser-franchisee relationship is intended or created by this Agreement.

General Provisions

THE COMPANY takes no responsibility for cash paid to Service Provider as THE COMPANY has no control over such activities. We discourage any tips or reward to any of our Service Provider however,if any, Customer is doing so is completely based on their own will and decision. Customers are requested to report/inform in accordance with the procedure established by law for any misconduct or unlawful behavior of any of Service Provider.

We encourage the customer to buy the required parts according to the service providers requirement. THE COMPANY will not be liable for cash or to any sort of money related acts such as not settling the balance, not providing the invoice of the parts etc.by giving the service provider cash to buy the required parts, the customer must take the full responsibility.

Changes to this Agreement and the Service

THE COMPANY reserves the right, at its sole and absolute discretion, to change, modify, add to, supplement or delete any of the terms and conditions of this Agreement (including the Privacy Policy (http://THE COMPANY /Progressive/content/pdf/Privacy_Policy.pdf) at any time, effective with or without prior notice.

Cancellation Policy :

  • If the service request is cancelled or rescheduled before the cancellation time limit, then the cancellation charges will NOT be applicable.
  • If the service request is cancelled or rescheduled after the cancellation time limit, then the cancellation charges will be applicable.
  • THE COMPANY reserves the right to cancel any service request at any point of time and will not be liable to anyone for the same.
  • If you are not at the location or the service provider cannot get in touch with you for the inspection. The service provider can contact Bellboy hotline and request to cancel the booking, the booking fee will not be refundable.

Rework Policy :

  • Rework Policy is only applicable for service issues related to workmanship. If there is any problem with spare parts or material, same will not be covered under Rework Policy.
  • Any kind of functional issue reported within warranty period post completion of work will be inspected by the service provider and if workmanship issue is identified, rework will be provided without any additional cost.
  • For any issue reported post the warranty period, the same needs to be booked as a fresh order and standard charges will be applicable.
  • For any extended warranties, please talk to service providers directly as THE COMPANY will not be responsible for such extended warranties.
  • Customers are advised to procure the spare parts themselves. THE COMPANY will not be responsible for any issues, defects, and quality of such material.
  • Any job which is beyond his technical expertise or scope of work, no rework will be encouraged for the same.
  • The Customer is advised not to directly contact service providers regarding an order booked through THE COMPANY.
  • For any kind of major dispute or disagreement between customer and service provider, THE COMPANY's supervisor will inspect and his decision will be final regarding the scope of rework.
  • In any case, overall rework value will not go beyond the service charges paid by the customer. THE COMPANY's discretion will be final for the rework amount.

    I HEREBY ACKNOWLEDGE THAT I AM IN FULL CAPACITY TO ENTER INTO AGREEMENTS AND I HAVE READ AND UNDERSTAND THE FOREGOING TERMS OF USE AND THE COMPANY PRIVACY POLICY AND AGREE THAT MY USE OF THE SERVICE IS AN ACKNOWLEDGMENT OF MY AGREEMENT TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT
