The mobile application ‘Bellboy’ operated by THE COMPANY i.e Urban Lifestyle Private Limited has provided a marketplace platform household and professional service providers which enables the link between a party/individual seeking for service requirements (“Customer”) and/or a party/individual offering such services (“Service Provider”). Customer and Service Provider together are hereinafter referred to as “Users” and individually as “User”. Those certain services requested by the Customer, which are to be completed by the Service Provider, are hereinafter referred to as “Services”.
Bellboy is a mobile marketplace for local services. We are the first startup to fill the void and fulfill the market needs for professional services.

Bellboy only provides service/s to Colombo 1-15 and suburb areas. The job request made out of the said regions will not be considered and therefore THE COMPANY is not liable to fulfill the job request.
Calm and clear communication is the most effective way to defuse any disagreement that may arise between the customer and service provider. All the customers and service providers are expected to be treated with respect and courtesy by one another.

THE COMPANY has minimum control over the quality, timing or legality of Services delivered by Service Provider.
THE COMPANY makes only a sincere attempt to provide best Service Providers and hence does not take full responsibility for suitability, reliability, timeliness, or accuracy of the Services requested and provided by Users. Although THE COMPANY does perform background checks of Service Provider, THE COMPANY cannot confirm that each User is whom they claim to be. THE COMPANY does not assume any responsibility for the accuracy or reliability of this information or any information on the Service.
NEITHER THE COMPANY NOR ITS DIRECTORS, OFFICERS, AFFILIATES OR LICENSORS IS RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE SERVICE. THE COMPANY AND ITS DIRECTORS, OFFICERS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY CLAIM, INJURY OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF THE SERVICE.
WE COLLECT AND STORE THE FOLLOWING PERSONAL INFORMATION: NAME, EMAIL ADDRESS, PHONE NUMBER, PRECISE LOCATION, USER ID, DEVICE ID AS WELL AS OTHER INFORMATION, INCLUDING USERS’ IP ADDRESSES AND STANDARD WEB LOG INFORMATION.

A customer’s personal information is utilized to:
Customer offer Service Payments for each requested service. Three days after a service is scheduled, if there is no complaint by the Customer, the service will be marked as closed by THE COMPANY, the agreed upon payment will be transferred to the Service Provider. The Service Payment must be paid only through THE Bellboy mobile application. Any Service Payments paid in cash outside of THE COMPANY mobile application are NOT subject to refunds.
* Failing to do the transaction within the agreed time period the COMPANY will take necessary actions for payment recovery.

Without limitation, THE COMPANY may terminate or suspend your right to use the Service if you breach any term of this Agreement or any policy of THE COMPANY posted on the Service from time to time, or if THE COMPANY otherwise finds that you have engaged in inappropriate and/or offensive behavior.
All text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and other content (collectively “Proprietary Material”) that users see or read on the Service is owned by THE COMPANY or are used by permission. Proprietary Material is protected in all forms, media and technologies now known or hereinafter developed. THE COMPANY owns all Proprietary Material as well as the coordination, selection, arrangement, and enhancement of such Proprietary Materials as a Collective Work under the Intellectual Property Rights Act, as amended.
You acknowledge that Confidential Information (as hereinafter defined) is a valuable, special and unique asset of THE COMPANY and agree that you will not disclose, transfer, use (or seek to induce others to disclose, transfer or use) any Confidential Information for any purpose other than disclosure to your authorized employees and agents who are bound to maintain the confidentiality of Confidential Information.
The term “Confidential Information” shall mean any and all of THE COMPANY’s trade secrets, confidential and proprietary information and all other information and data of THE COMPANY that is not generally known to the public or other third parties who could derive value, economic or otherwise, from its use or disclosure. Confidential Information shall be deemed to include technical data, know-how, research, product plans, products, services, customers, markets, software, developments, inventions, processes, formulas, technology, designs, drawings, engineering, hardware configuration information, marketing, finances or other business information disclosed directly or indirectly in writing, orally or by drawings or observation.
UNDER NO CIRCUMSTANCES WILL THE COMPANY,ITS AFFILIATES, ITS LICENSORS, OR ANY OF SUCH PARTIES' AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, CORPORATE PARTNERS, OR PARTICIPANTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF THE SAME.
If any dispute arises with one or more Service Providers, THE COMPANY (including our officers, directors, agents, investors, subsidiaries, and employees) will not be held responsible /liable from any and all claims, demands, or damages (actual or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
You hereby agree to indemnify, defend, and hold harmless THE COMPANY , its directors, officers, employees, agents, licensors, attorneys, independent contractors, providers, subsidiaries, and affiliates from and against any and all claim, loss, expense or demand of liability, including attorneys' fees and costs incurred, arising from your use, quality of service or inability to use the Services etc..
In case of any dispute between the Users and THE COMPANY, the parties agree to resolve the matter amicably vide arbitration under the Law of Sri Lanka.
No independent contractor, agency, partnership, joint venture, employer-employee or franchiser-franchisee relationship is intended or created by this Agreement.
THE COMPANY takes no responsibility for cash paid to Service Provider as THE COMPANY has no control over such activities. We discourage any tips or reward to any of our Service Provider however,if any, Customer is doing so is completely based on their own will and decision. Customers are requested to report/inform in accordance with the procedure established by law for any misconduct or unlawful behavior of any of Service Provider.
We encourage the customer to buy the required parts according to the service providers requirement. THE COMPANY will not be liable for cash or to any sort of money related acts such as not settling the balance, not providing the invoice of the parts etc.by giving the service provider cash to buy the required parts, the customer must take the full responsibility.
THE COMPANY reserves the right, at its sole and absolute discretion, to change, modify, add to, supplement or delete any of the terms and conditions of this Agreement (including the Privacy Policy (http://THE COMPANY /Progressive/content/pdf/Privacy_Policy.pdf) at any time, effective with or without prior notice.
